ENROLLMENT AGREEMENT

Between Defensive Driving Now School (TEA#C2036)

and You, The Student

The above named training facility, hereinafter referred to as "school", hereby agrees to provide the undersigned party, hereinafter referred to as "student", with no less than six (6) clock hours of driving safety instruction ("The Course"). The 6 hour course entitled USA Driver Safety Course (CP246), presented by Defensive Driving Now, is scheduled to be completed during the following time frame: The program must be completed within 180 days of registration. The total cost of the Program is $25.00 payable upon registration. This includes all required materials.

REFUND POLICY

All tuition and fees paid for the course are due and refundable when: 1) the course of instruction is discontinued by the school, preventing a student from completing the course; OR 2) the enrollment of student was procured as a result of any misrepresentation in advertising, promotional materials of the school, or representation made by an owner or employee of the school.

A student may request a refund for cancellation of the online course within 72 hours from the time of registration for a full refund as long as the student has not completed any section of the course. If a student chooses to cancel the online course after the 72 hour period, an $8 processing fee will be withheld from the refund of the course. If a student has not completed the course after 180 days from registration, the enrollment will be cancelled by Defensive Driving Now and the student will not be eligible for a refund. Defensive Driving Now will only accept refund requests in writing and all refunds will be issued within 30 days following the receipt of a request. Defensive Driving Now will remit payment to customer via original purchase method.

CANCELLATION POLICY

No refunds for the Program will be made to any student who has successfully completed the course or received a failing grade on the course examination. A student failing the personal or course validation aspects of the Program is considered to have completed the course but failed.

PERSONAL IDENTITY VERIFICATION AND FAILURE CRITERIA

This course includes a Personal Identity Verification test. Personal driver-related questions are asked intermittently throughout the program. You must answer 70% or more of these questions correctly to receive a certificate of completion. If you don’t have a Texas drivers license or a vehicle that you normally drive, to verify your Identity you will need to provide a notarized copy of the student’s drivers license or equivalent type of photo identification and a statement from the student certifying that the individual attended and successfully completed the six-hour driving safety course for which the certificate is being issued and for which there exists a corresponding footprint.

PRIVACY POLICY

Defensive Driving Texas is committed to protecting your privacy. This Defensive Driving Texas Statement of Privacy applies to Defensive Driving Texas Web sites and governs data collection and usage at any Defensive Driving Texas sites and services. Defensive Driving Texas does not use or disclose sensitive personal information without your explicit consent. Defensive Driving Texas may access and/or disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Defensive Driving Now or the site; (b) protect and defend the rights or property of Defensive Driving Now, including its Defensive Driving Texas web sites.

SECURITY OF YOUR PERSONAL INFORMATION

Defensive Driving Texas is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we store the personal information you provide on computer systems with limited access, that are located in controlled facilities. GRADING POLICY AND FAILURE CRITERIA

There are two content testing systems in this course, Comprehension Questions, and a Final Exam. Comprehension questions are asked intermittently throughout the program. You must score 70% or higher Comprehension Questions in order to receive your certificate of completion. You must also score 70% or higher on the final exam in order to receive your certificate of completion. For the final exam, alternative testing techniques for students with reading, hearing, or learning handicaps, and policies for retesting students who score less than 70% are as follows: A) Review the material; B) Re-test, verbally if necessary, for a total of no more than three attempts on the final exam.

DUPLICATE CERTIFICATE POLICY

USA Training Company will provide duplicate certificates for students. Persons requesting duplicates will submit a form provided by USA Training Company along with a cashier’s check, money order, or credit card# for $10 when applicable. USA Training Company can be contacted at (512) 346-2132.

GENERAL INFORMATION

The school is prohibited from issuing a certificate of completion if the student has not met all of the requirements for course completion and that the student should not accept a certificate under such circumstances. A student commits a Class A misdemeanor punishable by up to one year in jail if the student 1) signs a certificate and has not received 6 hours of instruction; and/or 2) falsifies any information on a certificate. This agreement constitutes the entire contract between the school and the student and no verbal assurances or promises not contained herein shall bind the school or the student.

STUDENT ACKNOWLEDGEMENTS

My confirmation of acceptance below signifies that I have been furnished a copy of the tuition schedule; cancellation and refund policy; and school regulations pertaining to validation policy, grading policy, rules of operation and loss and/or damage fees. I realize that any grievances not resolved by the school may be forwarded to Defensive Driving Now, 501 S. I represent that the personal information provided on this form is true and correct. I understand that the certificate of completion cannot be provided without complete and correct information.

I agree not to circumvent the Program and any attempt to circumvent the Program shall be in violation of this Agreement. I agree that I am solely responsible for any and all damages that occur from my attempted circumvention to Defensive Driving Now. I understand that my sole remedy for breach of this Agreement by Defensive Driving Now, and/or Intergalactic Pipeline, Inc. is the return of monies paid for the course. I expressly waive any claims for incidental or consequential damages.

PLEASE READ THE FOLLOWING IMPORTANT STATEMENTS:

Duplicate Certificate Policy. The Texas Education Agency will provide duplicate certificates for students. Persons requesting duplicates will submit a form provided by the TEA along with a cashier's check or money order for $10. Contact the Texas Education Agency if a duplicate is needed.

By accepting this agreement, I understand that a test is provided as part of the Program. I represent that I am the sole person that will answer the test questions and will do so without assistance from a source other than the Program, Program Instructor or other authorized material.

By accepting this agreement, I understand and agree that the certificate of completion is contingent upon my SUCCESSFUL COMPLETION of the program and verification that I have successfully completed the Program.

By accepting this agreement, I understand that a test score of anything less than 70% on the final exam may result in course failure and loss of fees paid for the course.

By accepting this agreement , I understand that I am allowing and giving my permission to Defensive Driving Now to access information about me other than the information provided by myself on this Agreement to validate my identity during the duration of the course. This information will be accessed by public database sources and includes but is not limited to name, address, and date of birth. This information will be used solely for validation purposes and will not be sold to any third party.

By accepting this agreement , I understand that course service interruption may occur during the attendance of this course.

By accepting this agreement , I understand that the minimum system requirements for this course are:
